B.L.U.E. End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and BlueHeaven Interactive LLC ("Company," "we," "us," or "our") governing your access to and use of B.L.U.E. (Build. Launch. Upgrade. Evolve.), including the game, website, software, services, content, and related materials (collectively, the "Services").

By accessing or using the Services, you agree to be bound by this Agreement.

1. License Grant

Subject to your compliance with this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment purposes.

All rights not expressly granted are reserved by the Company.

2. Ownership

B.L.U.E., including all software, artwork, music, audio, visual assets, trademarks, logos, designs, characters, code, documentation, and content, is owned by the Company and protected by applicable intellectual property laws.

This Agreement does not transfer any ownership rights to you.

3. User Conduct

You agree not to:

  • Modify, reverse engineer, decompile, or attempt to extract source code except where permitted by law.

  • Use cheats, exploits, bots, automation software, or unauthorized third-party tools.

  • Interfere with servers, networks, or systems supporting the Services.

  • Upload unlawful, offensive, or infringing content.

  • Violate any applicable law while using the Services.

We reserve the right to suspend or terminate access for violations of this Agreement.

4. User Content

Any content submitted by users, including feedback, suggestions, screenshots, videos, ship designs, forum posts, or other materials, may be used by the Company for the operation, promotion, improvement, and development of B.L.U.E.

You retain ownership of your original content but grant the Company a worldwide, royalty-free, perpetual license to use, reproduce, modify, display, distribute, and create derivative works from such content.

5. Updates and Changes

The Services may be updated, modified, suspended, or discontinued at any time without prior notice.

Features, content, game systems, progression mechanics, and online functionality may change during development and after release.

6. Online Services

Certain features may require internet connectivity.

The Company does not guarantee uninterrupted availability of servers, matchmaking, online services, or multiplayer functionality.

7. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.

The Company makes no warranty that:

  • The Services will be uninterrupted or error-free.

  • Defects will be corrected.

  • The Services will meet your expectations.

  • The Services will be secure or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, the Company, its officers, employees, contractors, affiliates, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Services.

The Company's total liability shall not exceed the amount paid by you for access to the Services during the twelve months preceding the claim.

9. Early Access Notice

B.L.U.E. may be offered in an alpha, beta, test, prototype, crowdfunding, or Early Access state.

You acknowledge that unfinished software may contain bugs, incomplete features, balance issues, data loss risks, and other unexpected behavior.

10. Termination

We may suspend or terminate access to the Services at any time if we reasonably believe you have violated this Agreement.

Upon termination, your license to use the Services ends immediately.

11. Governing Law

This Agreement shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.

13. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Agreement.

By using the Services, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms.
